Problems of qualification and improvement of the concept of criminal law counteraction to crimes in the field of bankruptcy

The article distinguishes misconduct in bankruptcy from related and competing elements of crimes, highlights the main criteria for their differentiation. Possible illegal actions of the debtor are analyzed, taking into account the positions of leading experts regarding the determination of the conditions for initiating proceedings to declare the debtor insolvent. The existing legislative gaps and conflicts are determined, the need for technical and legal improvement of the existing legal norms regulating public relations in the field of bankruptcy is substantiated. Possible problems are formulated in the qualification of illegal actions in bankruptcy, and ways to solve them are proposed, which will reduce the number of errors in law enforcement practice.
