On some problems of legislative regulation of civil proceedings in cases of compensation for moral harm

Abstract:

The article is devoted to the issues of legislative regulation of civil proceedings in cases related to compensation for moral harm. The analysis of theoretical provisions and normative legal acts, as well as materials of judicial practice in civil cases for compensation for moral harm, were carried out in order to identify and analyze the problems of legislative regulation of civil procedure on the consideration of cases by courts related to compensation for moral harm, and to determine ways to improve legislation RF. The authors use the analytical method and the method of comparative legal analysis. The results of this study show that issues of compensation for moral harm are difficult in establishing evidence in a civil case. The current civil procedural legislation does not contain an exhaustive list of evidence used to compensate for moral harm in court. The presence of these gaps in procedural legislation leads to the emergence of practical problems associated with the consideration of civil cases in courts. Also, based on the analysis of the problems of legislative regulation, proposals were formulated to improve legislation in the field of civil proceedings in cases of compensation for moral harm, such as consolidating the criteria for assessing moral harm, determining the limits of moral harm, clarifying the concept of moral and physical suffering, determining the minimum amount of compensation for moral harm , the introduction of measures of responsibility of officials of the judiciary for refusal of compensation for moral damage.
